General Conditions of Sale

Article 1 – Definitions

These General Conditions of Sale (hereinafter referred to as "TCS") are provided by the company FASHION CHAFRA, registered under number 983 102 013, with headquarters at 6 Rue Adolphe Crémieux, B29, 13200 Arles, France (hereinafter "FASHION CHAFRA").

Definitions:

• "Site": Refers to the website https://fashionchafra.com and all its pages, exclusively owned by FASHION CHAFRA.
• "Products" or "Services": Refers to all products and services available for purchase or subscription on the Site.
• "Seller": FASHION CHAFRA, the entity offering its Products or Services on the Site.
• "Client": Any individual or business user purchasing Products or Services on the Site.
• "Consumer": As defined in the French Consumer Code, refers to any individual acting outside their professional, commercial, or business capacity.

Article 2 – Scope of TCS and Purpose of the Site

The Seller reserves the right to amend these TCS at any time by publishing a new version on the Site. The applicable TCS for the Client are those in effect on the date of their order.

The Site provides details regarding the legal aspects of the Site's hosting, data processing, and privacy policy, as found in the Terms of Use, Legal Notice, and Data Privacy Policy.

This Site offers online sales of wax-based hair removal cosmetics and accessories. Access to the Site is free for all Clients.

Article 4 – Ordering Process

The Products and Services offered are those listed in the Site catalog. Each product is described by the Seller based on supplier information.

To place an order:

1. Select Product(s) and add them to the cart.
2. Review and edit the details of your order on the "Cart" page.
3. On the "Information" page, provide contact details and opt for email order updates.
4. On the "Delivery" page, choose a shipping method.
5. On the "Confirmation" page, enter payment and billing information.

The Client confirms the order by clicking "Finalize My Order," thus accepting these TCS. The order is validated upon receipt of payment.

Article 5 – Pricing and Payment Methods

Prices are in Euros, inclusive of all taxes (TTC), excluding shipping costs. FASHION CHAFRA reserves the right to adjust prices, but the price at the time of order will apply.

Accepted payment methods: Credit Card, Bancontact, Apple Pay, and Paypal. Payments are processed securely through an online payment platform.

Article 6 – Delivery

Shipping fees are displayed before payment. Orders are shipped worldwide, with estimated delivery times depending on postal services.

If a delay exceeds 30 days from the contract date, the Consumer may cancel the order via registered mail. The Seller will refund payments within 14 days of cancellation.

Article 7 – Right of Withdrawal

Consumers have 14 days to exercise their right of withdrawal. The product must be returned unused, in its original packaging, and in perfect condition. The Client bears return shipping costs.

A withdrawal form is available on the Site.

Article 8 – Product Warranties

Products are covered by a legal conformity warranty and a hidden defects warranty. In case of non-conformity, the Client may request an exchange or refund, with return shipping costs covered by the Seller.

Article 9 – Liability

FASHION CHAFRA is not liable for indirect damages related to the use of its Products or Services. The Seller's liability cannot be engaged in cases of force majeure, user errors, or product incompatibility.

Article 10 – Force Majeure

In the event of force majeure (unforeseeable and uncontrollable events), order execution is suspended. If the situation persists for more than 90 days, either party may terminate the contract.

Article 11 – Intellectual Property

All elements of the Site are protected by intellectual property rights. Any reproduction without permission is prohibited and may result in legal action.

Article 12 – Personal Data

FASHION CHAFRA collects and processes Clients' personal data for order management and Site improvement. Data is retained for a maximum of 5 years and secured by Shopify.

Article 13 – User Comments

By submitting comments, the Client grants FASHION CHAFRA the right to use them freely. FASHION CHAFRA reserves the right to delete any inappropriate content.

Article 14 – Severability

If any provision of these TCS is deemed unenforceable, the remaining provisions remain valid. These TCS supersede all prior agreements.

Article 15 – Governing Law and Mediation

The TCS are governed by French law. In case of disputes, mediation can be requested by the Client via the European Commission's dispute resolution platform.

Article 16 – SMS Policy

By opting into SMS marketing at checkout, the Client agrees to receive notifications, even if their number is on a do-not-call list. They may unsubscribe at any time by replying "STOP."
